Pre-trial motion results in breast surgeon’s discontinuance from Kings County wrongful death lawsuit

Larry Bloomstein and Robert Isabella successfully obtained discontinuance of a breast surgeon charged with failing to biopsy a breast with suspicious findings found on mammography.  The patient later died due to metastatic breast cancer.  The litigation team successfully argued  before a Kings County trial judge on the eve of jury selection that a key expert designated to testify against ARFD’s client should be precluded from doing so.  The court sided with ARFD and the claims against the breast surgeon were ultimately discontinued.
