Andrew Kaplan obtains a defense verdict on behalf of general surgeon in Westchester County
Aaronson Rappaport proudly congratulates trial partner, Andrew Kaplan, on a defense verdict obtained in Westchester County Supreme Court last week. Andrew was supported by his trial team including associates, Nadia Ali and Andrew Benard, and appellate counsel, Deirdre Tracey.
The case involved a 56-year-old man, who underwent liposuction and abdominoplasty by the co-defendant physician. Mr. Kaplan’s client, a general surgeon, performed a concurrent hernia repair at the umbilicus at the same time. Plaintiff alleged that, during the liposuction and abdominoplasty, the plaintiff’s cecum was perforated and there was a delay in diagnosing the perforation.
After the three week trial, the Jury exonerated both physicians, accepting the defense position that the liposuction wand could not have caused the perforation and that the defendant general surgeon timely returned the plaintiff to the operating room before he suffered a true colonic rupture.
