ARFD clients granted summary judgment dismissal in Kings County

ARFD associate Jonathan Tamir, supported by partner Phillip HoSang, Jr., was recently able to obtain summary judgement following a motion filed on behalf of a hospital and three physician assistants in a medical malpractice matter concerning a spinal surgery with fusion. Plaintiff claimed that the hospital and physician assistants were negligent in performing the surgery and that their follow up care caused a spinal fluid leak and buildup. Due to the allegations, plaintiff claimed multiple injuries including incontinence and loss of sensation in plaintiff’s legs. The Court granted the motion in its entirety for all our clients findings that the hospital and the physician assistants were not liable for the alleged malpractice. As the Court determined that there were no triable issues of fact, it dismissed the complaint against them in its entirety.
