ARFD Partner, Nick Marotta, obtains defense verdict in Suffolk County!
Aaronson Rappaport Trial Partner, Nicholas Marotta, obtained a defense verdict on behalf of a neurosurgeon in a case involving claims that the surgeon failed to obtain preoperative pulmonary clearance prior to performing a spinal tumor resection surgery. Plaintiff claimed that the failure to obtain preoperative pulmonary clearance resulted in the patient being fluid overloaded during surgery. Mr. Marotta was able to establish that the medical clearance given by the patient’s primary care physician was adequate, that the lack of pulmonary clearance played no role in the anesthesiologist’s intraoperative fluid management, and that none of the plaintiff’s symptoms following the surgery were related to the lack of pulmonary clearance. The Suffolk County jury returned a verdict for the surgeon finding that the surgeon did not deviate from the standard of care by performing surgery on the plaintiff without obtaining pulmonary clearance.
