Peter J. Fazio, Partner

Peter J. Fazio received a Juris Doctor degree from New York Law School and joined Aaronson Rappaport upon graduation. His practice areas of expertise are product liability defense, medical malpractice, toxic torts/mass torts, class action litigation, pharmaceutical/medical devices litigation, pharmaceutical/medical devices litigation, and premises liability.

Mr. Fazio has significant experience in the defense of product liability suits against major automobile manufacturers and has participated in several high-exposure cases with catastrophic injuries and fatalities resulting in defense verdicts. He also assists his clients with the development and implementation of national litigation strategies for both individual and class action cases.

Mr. Fazio’s client service and work product was recognized by Ford Motor Company, which named him as one of its “Next Generation Trial Lawyers.” He is admitted to practice in New York, New Jersey, United States District Courts for the Southern, Eastern and Northern District of New York; United States District Court of the District of New Jersey and United States District Court for the Western District of Texas. He also has served as national trial counsel in other jurisdictions, including, but not limited to, Alabama, California, Florida, Indiana, Michigan, Mississippi, South Carolina, Texas and West Virginia.

From the beginning of each case, Mr. Fazio recognizes the importance of mastering the complex so that he can persuasively present the issues before both the court and jury. His ability to distil complex scientific issues – combined with his close client rapport – have resulted in obtaining several preclusion orders pursuant to both the Frye and Daubert standards.   • George v. Ford Motor Company, United States District Court, Southern District of New York, defense verdict: product liability design defect resulting in three fatalities and several catastrophic injuries.
  • Borsack v. Ford Motor Company, United States District Court, Southern District of New York, defense verdict: product liability design defect resulting in a fatality.
  • McMahon v. Ford Motor, New York State Supreme Court, New York County, defense verdict: product liability design defect resulting in paralysis.
  • Pacheco v. TRW Automotive, New York State Supreme Court, Richmond County, defense verdict: product liability design and manufacturing defects resulting in neurologic injuries.
  • Rotter v. Ford Motor, New York State Supreme Court, Nassau County, defense verdict: product liability alleging design defect resulting in neurologic injuries.
  • Santos v. Ford Motor Company, New York Supreme Court, Bronx County, defense verdict: product liability design defect resulting in two fatalities and catastrophic injuries.
  • Martin v. Ford Motor Company, New York Supreme Court, Queens County, defense verdict: product liability design defect resulting in one fatality and several catastrophic injuries.
  • Roush v. Ford Motor Company, Grant County Superior Court, Indiana, defense verdict: product liability design defect resulting in one fatality and catastrophic injuries.

Mr. Fazio is an active lecturer on topics including, but not limited to, medical malpractice, automobile product liability litigation and the New York State Justice Center. He is a member of the American Bar Association and the International Association of Defense Counsel and was a contributor to the New York Law Journal Smart Litigator on product liability.
