Lawrence Rosenblatt successfully argues for summary judgment in bed sore case in Brooklyn
Lawrence Rosenblatt obtained summary judgment for a Brooklyn hospital in a bed sore case in Kings County where, it was alleged, his client and co-defendant institutions allowed the decedent to develop multiple bed sores, leading to osteomyelitis and death.
During oral argument, Lawrence focused, inter alia, on the deficiencies in the plaintiff’s expert’s affirmation, arguing that the expert’s opinions did not properly provide causal connection – to either conscious pain and suffering or death- to the stage 2 ulcer that developed at his client’s institution. Upon questioning by the Court, plaintiff’s counsel conceded that their expert grouped all of the ulcers sustained by the decedent – including stage 3 and stage 4 ulcers that developed at co-defendant institutions – in forming expert opinions.
