Lawrence W. Rosenblatt obtains a medical malpractice defense verdict in Queens County
ARFD Partner, Lawrence W. Rosenblatt, and his stellar trial team represented an emergency medicine physician, a hospital and health care system in a medical malpractice action alleging a failure to timely diagnose and treat a pulmonary embolism in the hospital’s ER, resulting in the death of a 53 year old woman while still in the Emergency Department. The Case was tried for 3 1/2 weeks in Supreme Court, Queens County. The court allowed six departure questions to go to the jury, including a ‘loss of chance’ jury charge. The plaintiff requested that the jury award 1.5 million dollars for pain and suffering as well as pecuniary loss to the decedent’s three adult children. The jury deliberated over the course of two days, returning a 6-0 unanimous defense verdict on all six departure questions.
