Plaintiff Rejects $3.3 million Settlement Offer, then Has Case Dismissed on Basis of Frye Motion

Following a Frye hearing, handled by Jay Rappaport, the plaintiff was offered $3.3 million to settle. Plaintiff rejected the offer on the record. Later the same day, the court rendered a decision dismissing plaintiff’s case, finding that plaintiff’s proximate cause theory was flawed under a Frye analysis (pending appeal).
