Robert S. Deutsch obtains medical malpractice defense verdict in Queens County

Aaronson Rappaport would like to congratulate trial partner, Robert Deutsch, who recently obtained a defense verdict in Queens County after the jury found that the defendant’s care did not cause plaintiff’s injuries. Mr. Deutsch was assisted on the case and at trial by associate, Daniel Oresajo.

The case involved claims that the defendant surgeon failed to properly treat plaintiff’s postoperative infection with the appropriate antibiotics. While the jury found for the plaintiff on the liability question of whether the defendant failed to change the antibiotic in question following cultures that revealed a different bacteria not susceptible to the prescribed antibiotic, the jury also accepted the defendant’s position that the antibiotic care was irrelevant to the cause of the postoperative infection. Thus, the defense prevailed.
